TERMS OF SERVICE
All purchased patterns and kits are for your own use only and you are not allowed to share, or resell, any The Blackwork Company charts.
Please note that you are not allowed to use any of my charts, or portions of them, to create new patterns to sell or give away.
You may sell any physical item you create from my patterns, on a small scale.
General
This website, found under the www.theblackworkcompany.com URL and references to ‘you’, and ‘your’ shall be deemed to be references to persons placing an order via the www.theblackworkcompany.com website. These terms & conditions also covers emails, newsletters, Facebook and any other associated promotional activity.
Orders
When you place an order with me it will be deemed that you have read, understood and agreed to these Terms & Conditions. If you are unhappy with any part of these terms and conditions, you should contact me before placing an order.
By placing an order through my website you are making an offer to The Blackwork Company to purchase the goods outlined in your order upon the terms described in your order.
After placing an Order, you will receive an email from The Blackwork Company acknowledging that we have received your Order. Please note that this does not mean that your Order has been accepted. Your Order constitutes an offer to us to buy a Product. All Orders are subject to acceptance by The Blackwork Company, and we will confirm such acceptance to you by sending you an email that confirms that your payment has been processed (“Payment Confirmation”) The contract between us (“Contract”) will only be formed when we send you the Payment Confirmation.
The Contract will relate only to those Products we have confirmed in the Payment Confirmation. The Blackwork Company will not be obliged to supply any other Products which may have been part of your order until the acceptance of such Products has been confirmed in a separate Payment Confirmation.
If any of these Terms conflict with any term of the Order, these Terms will take priority
We shall assign an order number to the Order and inform you of it in the Payment Confirmation. Please quote the order number in all subsequent correspondence with us relating to the Order.
If The Blackwork Company is unable to supply you with Products, for example because those Products are not in stock or are no longer available, we will inform you of this by email and we will not process your Order. If you have already paid for the Products, we will refund you the full amount as soon as possible.
Please note that whilst I will make every effort and reasonable care to keep your order details secure, I cannot be responsible for any loss you may suffer if a third party procures unauthorised access to any information that you supply when accessing or ordering from the The Blackwork Company website via Stripe.
When placing an order you will be added to The Blackwork Company’s Newsletter mailing and email list. However should you wish to not receive mailings, please inform me and I will remove you from the list. You can remove yourself from the Email list by amending your email preferences via the link at the bottom of each email.
Website Product Pricing & Descriptions
Every product bought is sold subject to its product description which outlines any further specific conditions that relate to that product including, without restriction, terms and conditions that regarding approximate delivery dates/times, warranties, after-sales support and guarantees.
I undertake all reasonable care to ensure that all the details, prices and descriptions of products on my website are accurate at the time when they are either entered onto our system or printed. Whilst I endeavour to keep the website as up-to-date and accurate as is possible, there may be very rare occasions when the information on the website (including product descriptions) at a certain time may not reflect the position exactly at the point an order is placed. I do not give any warranty as to the accuracy or completeness of the information and cannot be responsible for any errors or omissions or for the results arising from the use of such information. Please note that I am unable to confirm the price of a product until your order is accepted in line with our order acceptance conditions.
Any drawings, photographs or advertising we issue, and any photographs or illustrations contained on our Site, are issued or published solely to provide you with an approximate idea of the Products shown. There may be slight variations between these photographs or illustrations and the Products which you receive. Full detailed specifications are available from the manufacturer’s brochures or their websites. We will supply the product as supplied to us by the manufacturer.
Faulty Goods
Goods are faulty if they are received damaged or where a manufacturing fault occurs within six months of purchase; however this does not include the results of normal wear and tear.
Contract Cancellation
If you are not happy with products you have chosen and received, you are entitled to cancel this contract if you so wish under the Distance Selling Regulations, provided you exercise your right no longer than fourteen working days after the day on which you receive the products (this excludes digital items). Please note however that I pride myself on my commitment to the highest levels of customer service and will consider every situation on a case by case basis, subject to the situation, after this period.

Promotions
Please note that only one promotional offer can be used at any one time and any Promotion Codes are not valid in Sale periods or on Clearance items that have already been discounted.
Disclaimer & Limitations of Liability
The Blackwork Company does not look to exclude or limit liability for personal injury or death arising from its negligence or that of its employees, agents, members or directors or for any misrepresentation that is fraudulent.
To the utmost extent allowed by law and save as provided above, neither The Blackwork Company nor any linked company shall be liable to you by reason of any representation, or any implied condition, guarantee, or other term, or any duty at common law, or under the express terms of the contract, or in negligence (whether on the part of The Blackwork Company or any of its employees, agents, members or directors or otherwise) for any indirect special or resultant loss or damage (including but not limited to loss of profit or loss of saving), expenses, costs, or other claims for compensation whatsoever which arise out of or in connection with the use of the The Blackwork Company website, the supply of the products or their use of resale by you).
These limitations of liability, as outlined here, shall apply equally for the benefit of The Blackwork Company and any other linked company as if references to The Blackwork Company included references to each linked company. Whilst we try and do everything reasonable to try and keep the information on this website up-to-date and correct,The Blackwork Company do not give any warranty to its completeness or correctness and The Blackwork Company cannot be held responsible for any omissions, errors or for any resulting implications from the use of this information.
The Blackwork Company make all reasonable effort to ensure a reliable and fast service but we do not guarantee that you that your use of this website will be free from interruption or errors and cannot be held responsible for any disruption, loss of or corruption of any material in transit, or loss of or corruption of material or data when downloaded onto computer systems.
